Dropped kerb application process
The following guidance notes outline the crossover application process that needs to be followed to gain formal approval from the council for construction of a vehicle crossover (dropped kerb) across a public footway or footpath and/or verge.
Each site will be evaluated individually and in relation to the current policy.
Please note: Markings placed on the footpath/kerbline do not constitute approval of your application. Do not proceed with any works on your property (such as hardstanding/surfacing or demolition of a wall, etc) until you have received a firm quotation, returned your acceptance form and have our written permission to proceed.
Similar installations within a specific localised area will not automatically result in the approval of a given application. Older, historical crossovers in the same area do not always imply that a crossover will be approved.
Application
- We aim to process and reply to each application within 10 to 15 working days of receiving it.
- All crossover application forms are given a unique reference number - please quote this number if you need to contact us about your application.
Estimate
- The council is required to construct the crossover at the expense of the applicant. Successful applicants will be sent an estimate for the construction of a crossover, and an agreement form, which must be signed and returned to us with payment.
- The estimate will show the charges for the crossover and any necessary alterations if required - for example, street furniture relocation, parking bay removal. The estimate sent is based on the council's agreed schedule of rates with the term service contractor.
- The estimate and any application will be valid for a period of 90 days starting from the date on your estimate letter. After this time, a new application and fee may be required.
- Upon written approval from our highways team and once payment is received in full, location details will be added to the works programme for the contractor who constructs crossovers on our behalf. The aim is for crossovers to be constructed within 8 weeks of receipt of payment.
Refused applications
- Where applications do not conform to the eligibility criteria, applicants will be informed in writing of the reasons for refusal.
- Unsuccessful applicants who believe their applications have not been processed in accordance with the criteria set out in the council's
Domestic Vehicle Footway Crossover Policy (PDF)
[5MB] , or that there are exceptional circumstances, have the right of appeal.
Appeals
- An appeal will not be considered solely on account of older existing crossovers in an applicant's road or elsewhere if it does not comply with the current policy criteria.
- Requests for reconsideration of a refusal decision will only be allowed and considered as an appeal if applicants can demonstrate:
- their applications have not been processed in accordance with the criteria set out in this policy or
- there are exceptional circumstances that would justify an exception to be made to the policy.
- All appeals will be considered in 2 stages (by the highways manager and the by the director).
